Staff Report & Agenda Item Details

The public hearing is part of the process required for TEFRA (Section 147(f)) of the Internal Revenue Code approval proposed in order for the bonds to be issued as tax-exempt. A TEFRA approval was received by the Commissioners Court in May 2024 for this project. However, the project was delayed. It is now ready to move forward with an anticipated closing date on the week of March 16, 2026. The TEFRA approval must be within 18 months of the closing date; therefore, a new TEFRA approval is needed.

On February 3, 2026, the TCHFC approved the set date of February 24, 2026 at 9 am for the public hearing. The required notice was published in the Austin American Statesman on February 16, 2026.

The purpose of the hearing is to provide residents of Travis County (the “County”) an opportunity to comment on the proposed issuance by the Corporation of its Multifamily Housing Revenue Bonds to be issued in one or more series (the “Bonds”) in an aggregate maximum stated principal amount of not more than $40,000,000.

The Bonds will be issued for the benefit of Roers Austin Apartments Owner IV LP, a Texas limited partnership (the “Borrower”), in connection with the acquisition, construction and equipping of an approximately 176-unit multifamily housing development to be located at 1706 Payton Gin Road, Austin, Travis County, Texas 78758, or adjacent thereto (the “Development”). The Borrower will own the Development. It is anticipated that a wholly-owned subsidiary of the Corporation will own the land on which the Development is located and lease such land to the Borrower. Further, it is anticipated that TCC Hill Country Development Corporation, a Texas nonprofit corporation, will be the sole member of the general partner of the Borrower.

The Bonds will be limited obligations of the Corporation, payable solely from the revenues, receipts and resources of the Corporation pledged to their payment. The Bonds will not constitute an indebtedness or obligation of the County (or any other city, county or other municipal or political corporation or subdivision of the State of Texas) or of the State of Texas, or a loan of credit of any of them, within the meaning of any constitutional or statutory provision.
